RICHMOND, Va. -- The Richmond teen accused of killing "tiny hero" Marty Cobb is now charged with first-degree murder in the eight-year-old boy's death. Mairese Washington, 16, previously faced a second-degree murder charge. That charge was upgraded Monday following the meeting of the grand jury.

Washington’s two day trial is set to begin on November 17.

Cobb was killed May 1 along Brandon Road near his South Richmond home.

Family members said Marty Cobb was defending his 12-year-old sister from Washington when the teen then attacked Marty.

Washington was arrested two days later in connection with the homicide.

In June, a judge ruled Washington would be tried as an adult. Prior to that ruling, CBS 6 did not name Washington as the suspect, per station policy regarding the anonymity of juveniles.
