HENRICO COUNTY, Va. -- A Henrico County Circuit Court judge convicted a Short Pump Massage Envy employee of assault and battery and sentenced him to six months in jail following an August 2019 incident.

Anthony Contino was charged with aggravated sexual battery after a victim alleged she inappropriately touched her during a massage on August 1, 2019.

She immediately reported the alleged assault to police and went to the hospital to have an exam.

Contino pleaded not guilty.

The Henrico judge said, "this was obviously a massage that went too far and the victim did receive touching that she did not want."

However, he said the incident did not rise to the level of aggravated sexual battery, a felony charge, or sexual battery.

Contino was sentenced to 12 months with six months suspended.

Continos's attorney argued that the victim's story had some inconsistencies.

The victim told investigators that she did not stop by the front desk and have a conversation with anyone at the Massage Envy. But the Massage Envy staff testified that the victim did spend "four to five minutes" at the front desk trying to get a discount negotiated on her massage.

A Henrico detective testified that Contino admitted to touching the victim's breasts and the side of her genital area.
