RICHMOND, Va. — The former Chesterfield Marine who sued after being forced to undergo a psychiatric evaluation has suffered a legal defeat.
The Fourth Circuit Court of Appeals refused Wednesday to reinstate a lawsuit filed by Brandon Raub.
Raub’s arrest at the hands of federal agents was captured on cell phone video in 2012 after investigators said it stemmed from anti-government Facebook postings that alluded to violent acts.
Raub was later involuntarily committed to a mental hospital.
After he was released, he filed a lawsuit, arguing that his rights to free speech and protection against unlawful seizure had been violated.
However, a three-judge panel of the appeals court has unanimously upheld a lower court ruling that shot down Raub’s claims.
Raub’s lawyers said they will appeal to the US Supreme Court.
