CHESTERFIELD COUNTY, Va. -- A Chesterfield man has been arrested for allegedly sexually assaulting an 11-year-old girl.
A court affidavit states that the girl claimed the sex was consensual. However, 35-year-old Neri Grijuala has been charged with rape and is being held by Immigration and Customs Enforcement on an immigration detainer.
Police arrested Grijuala, who had been subleasing a room inside a Meadowdale Boulevard apartment home, and charged him with the rape stemming from an alleged incident on March 28.
Neighbors told CBS 6 reporter Jon Burkett that and police confirmed that the victim does not live in the complex, but is known in the neighborhood.
"She's dropped off during the day by her mother. She doesn't live in this neighborhood -- no money, no food,” Nicole Mitchell, the suspect's roommate said. "Bounces from apartment to apartment... You watch her just talking to random people."
Search warrants show that police recovered a brown fleece blanket and light brown sheet. They also sent the girl to a local hospital for a rape test.
A woman who lives with Grijuala said that she is curious as to how the incident happened because she was in the room next door.
"Nobody else came in the house but the people who lived there,” Mitchell said.
When pressed if the 11-year-old had come into the apartment, she replied, “No.”
Grijuala is being held at Riverside Regional Jail on an immigration detainer. He also faces charges for falsely identifying himself to law enforcement and forging public records.
