California man sues airline over soda

(WTVR) – A California man has sued Virgin America Airlines over a fight he had with a flight attendant over a soda.

According to ABC News, 52-year-old Salvatore Bevivino was on a flight from Philadelphia to San Francisco when he pressed the call button to ask a flight attendant for a soda.  The attendant told Bevivino to use the touch screen console in front of him.

Bevivino said he didn’t want to turn on the console, but the flight attendant said he didn’t have time for Bevivino’s attitude.

Another flight attendant told him the same thing.  A third attendant finally brought him a soda.

Police questioned Bevivino after the plane landed.  Some flight attendants said he used vulgar language after the altercation.  Bevivino denied that claim and was released 20 minutes later.

Later, Bevivino called Virgin Airlines Customer Service and asked about their ordering policy.  “I was told that if I elect not to use the console, the flight attendant has to provide you with one-on-one service,” he told ABC News.

He hired an attorney a month later because he claims one of the flight attendants lied about the situation.  He is now asking for $500,000.

A spokesperson for Virgin America refused to comment on the situation.
