Update 9/21/09 1 p.m.CBS 6 News has learned that McCroskey is at the Piedmont Regional Jail in isolation, close to Booking where he can be watched.
Richmond Defense Attorney, Cary Bowen, tells CBS 6 he met with his client Richard McCroskey today. "He's in shock... He knows there's some dead people and he's feeling pretty bad... I'm just trying to take care of him", says Bowen.
Bowen says he didn't ask his client about the case, and never brought up the statement he made to a CBS 6 reporter shortly after his arrest claiming "Jesus told me to do it".
Bowen also said he's still investigating whether or not his client should be examined to see if he's competent to stand trial. "We're not there yet", he said.
Police say shortly after McCroskey robbed and killed Mark Niederbrock, McCroskey stole his 2002 Honda, wrecked it six miles down the road, got a ticket for driving without a license, and had to get the car towed.
The tow truck driver, Elton Napier says McCroskey asked him for a ride to a nearby Sheetz store. Napier said McCroskey didn't say much.
" I asked him where he was from, and he told me California. I said 'what in the world are you doing down here? And he said 'my girlfriend lives down here'. I asked him who's car is this? He said my 'girlfriend's dad's car' ", says Napier.
Napier said he never had a weird vibe about what McCroskey said, but did have a weird vibe about what he saw and smelled.
"He (McCroskey) had bruises throughout his neck.. He said his girlfriend did that. He smelled so bad I had to put my head out the window alittle bit. It was strong,you know? I got a pretty good stomach and I was heaving", says Napier.
Napier said McCroskey was wearing the same clothes he appeared in during his arrest.
Napier says he left McCroskey at the Sheetz, got himself a couple of coffee and when he walked out he saw McCroskey talking to some deputies.
"I told one of the deputies 'you need to give that guy a bath..because he really smells bad'. He looked at me and grinned and said 'I know he does', says Napier.

Richard Alden Samuel McCroskey III appeared in a Prince Edward County courtroom and was appointed an attorney Monday morning. Cary Bowen, an attorney from Richmond, was assigned to the case but was not present in court and not talked to the suspect.
A preliminary hearing was set for January 11 because of the amount of evidence discovered.
Meantime, we're learning more about the family believed to be the victims in the quadruple murder.
Family and friends of Pastor Mark Niederbrock say he was a loving and concerned father, fearing his 16-year-old daughter was going down the wrong path.
Family friend and church elder Marvin Glover says, "There wasn't a whole lot he could do. She was just very rebellious."
