RICHMOND - The investigation into the tragic death of a toddler is wrapped up and the Virginia Department of Social Services recommends that the Yellow Brick Road Daycare and Learning Center lose its license.

Little Andrew Johnson was left on a daycare van earlier this month and died of heat exposure. The daycare owner Valerot Whitlow tells CBS 6 she received word of the recommendation on Wednesday. She says "I know they have a job to do, but I want people to be clear that it is just a recommendation and I plan to fight it all the way." Whitlow's son, Keishawn Whitfield was driving the daycare van the day Johnson was left behind.

Investigators with Social Services determined that the child was in the van for about seven hours. "It is our determination that the child died in that van," said Jeffrey Williams, a Licensing official with the department. Williams says the revocation recommendation will be forwarded to Lynn Williams, the division director for a decision. If she upholds the recommendation, Whitlow will have as many as three opportunities to appeal. She'll also have the right to an informal conference if things get that far.

During that conference Whitlow would be allowed to present her case and tell officials why her daycare should be allowed to continue to operate.
