Police announce charges in connection with the case of a naked man attacked in the middle of a Richmond street. The incident was recorded by a bystander, Cari Werz, with a cell phone.
The naked man and victim, 28 year-old Samuel Byers has been charged with public indecency, a misdemeanor.
Investigators say 39 year-old Thomas Darlington Connor, Jr. from Richmond participated in the attack. Police are trying to find him. They say assault charges will likely be filed against the other two men once they are positively identified.
The incident happened Sunday morning, July 25, 2010 in Richmond's Fan district on the corner of West Main and Robinson Street soon after the bars let out.
Police say Byers, intoxicated and completely nude walked up to an SUV full of men. In the video, you see three men jump out of the SUV. One of them punches Byers, and the other two kick him.
After CBS 6 obtained the video, we questioned why police had not arrested anyone for the attack, or asked Werz for the video because she offered it to the officers on duty that night but they declined to take it.
Police responded by saying the police officers were told by both parties they did not want to press charges.
Weeks after our story aired, police opened an investigation. Richmond Police spokesperson Gene Lepley says a Major Crimes supervisor reviewed the report and ordered a detective to conduct an investigation. They interviewed Werz and got the video, and they tried to obtain surveillance video of the Star-lite Lounge where Byers is seen outside, but a worker at Star-lite says that video had recorded over.
After reviewing the detective's report and viewing Werz's video of the attack, the Commonwealth's Attorney's office made the decision to bring a felony charge of malicious wounding against Conner. Byers was later charged.
Connor is described as 6'0", 210 pounds with black hair and brown eyes. He has no current Richmond address.
