Will Horton, general manager of the Rock Falls Tavern plays by the rules when it comes to Virginia's state smoking ban --- with a smoking and non-smoking section.
He says he's lucky the ban hasn't affected his bottom line.
"Business has been pretty good", he says.
And he's well aware of the fact that Virginia ABC has the right to take their license if a restaurant gets caught and convicted several times.
"We knew coming in they were going to be a major player to this. A lot of people thought they weren't going to have any involvement, but when you have an ABC license business, they come in no matter what the law is", says Horton.
Virginia ABC says "If local authorities get repeated convictions, they can turn it over to the ABC Board. It would then be docketed for an ABC administrative hearing. If the hearing officer finds that the charges are substantiated, the licensee can be either fined or their liquor license revoked, or the case could be dismissed"
Some feel the bars are being unfairly targeted.
"It's kind of harsh. I don't see where the two even match up", says restaurant patron, Neal Adams.
Others disagree.
"ABC as a state agency has the right to oversee the license", says restaurant patron, Dan Williams.
